Аннотация
В Беотийском союзе III–II вв. до н.э. сохранялись многие традиции федеративной государственности в Беотии, восходящие к классическому периоду, в т.ч. параллельное отправление правосудия городскими и федеральными судебными органами. Сведения нарративных и эпиграфических источников позволяют отнести к сфере федеральной юрисдикции рассмотрение споров между полисами, прежде всего, территориальных, уголовное правосудие по делам о преступлениях против союза (убийство должностных лиц федерации, попытка государственного переворота), а также, вероятно, гражданское судопроизводство в тех случаях, когда имущественные тяжбы затрагивали интересы разных общин и их граждан. Ряд исследователей не без оснований считает, что примером этой последней категории дел является тяжба Никареты из Феспий с властями города Орхомена, которая, возможно, была урегулирована лишь после вмешательства федеральных органов. Какие именно органы выполняли в Беотии роль судов федерального уровня – постоянное судебное учреждение или временные комиссии, создаваемые каждый раз для рассмотрения одного или нескольких дел, – определить пока невозможно. Предположение, согласно которому в качестве федерального суда выступала коллегия фесмофилаков, представляется довольно спорным. С определенной долей уверенности можно, однако, утверждать, что беотийцы, в отличие, скажем, от ахейцев и фессалийцев, воздерживались от приглашения иностранных арбитров для рассмотрения споров, возникавших внутри союза, что косвенно может свидетельствовать о налаженной системе использования собственно беотийских судей для осуществления функций федеральной юстиции. Рассказ Полибия (XX. 6. 1–3) о длительном прекращении всякого правосудия в Беотии на рубеже III и II вв. в современной научной литературе правомерно признается не слишком достоверным, однако некий кризис судопроизводства, как городского, так и федерального, в этот период должен был иметь место на самом деле, хотя причины и проявления этого кризиса не вполне ясны.
